  • What happens if I get a first-time DUI in New Jersey?

    Penalties for a first offense may include fines ranging roughly from $250 to $400, along with additional state fees and court costs. License suspension can last about 3 months for lower BAC levels, or up to 12 months for higher readings. An ignition interlock device may also be required, along with mandatory attendance at an Intoxicated Driver Resource Center program. Additional yearly surcharges may apply for several years.

  • Will I go to jail for a first DUI offense?

    Jail time is not typically required for a first offense, but courts do have the authority to impose up to 30 days in jail depending on the circumstances.

  • What if I refuse to take a breath test?

    Refusing a breathalyzer can lead to license suspension ranging from several months up to a year, fines, and a requirement to install an ignition interlock device after driving privileges are restored.

  • Can I get a restricted or work license if my license is suspended?

    New Jersey does not offer hardship or work-only licenses. However, drivers who install an ignition interlock device may still be allowed to drive for essential purposes such as work, school, or medical needs.

  • Does a DUI show up as a criminal offense in New Jersey?

    In New Jersey, DUI charges are treated as traffic violations rather than criminal offenses, so they do not result in a criminal record.

  • What is the legal blood alcohol limit?

    For drivers aged 21 and older, the legal limit is 0.08% BAC. For drivers under 21, the limit is significantly lower at 0.01%.

  • Can DUI charges be filed after the incident?

    Yes, charges may be filed days or even weeks later if authorities are waiting on test results or additional evidence.
